The Law Against Discrimination (LAD) prohibits discrimination and harassment in emergency and trauma facilities, including hospitals, urgent care centers, vaccination and testing sites, ambulatory care centers, and more based on actual or perceived:
- Race or color
- Religion or creed
- Disability
- Gender identity or expression
- Liability for military service
- National origin, nationality, or ancestry
- Pregnancy or breastfeeding
- Marital or domestic partnership or civil union status
- Sex
- Sexual orientation
The law applies in all aspects or care and means that you cannot be treated differently or harrassed, or:
- Denied services, treatment, or care-related items free of cost to other patients;
- Ignored when you report symptoms or conditions; or
- Tested more than necessary or without consent
Based upon membership in a protected class.
Remedies may include money damages, an order to stop discrimination or harassment, adoption of new policies and procedures, attorney's fees, and more.
